Policies

CONFIDENTIALITY

  • All matters are kept completely confidential and will not be shared without your consent.
  • Employees and independent contractors are held accountable to uphold standard confidentiality rules and policies.

CHARGES & PAYMENT

  • Happily Organized performs indicated services for a fee of $85 per hour. Additional time may be booked at an additional $85 per hour. Sessions of 5 hours or more are scheduled with an optional unpaid meal break. Design time and time exceeding scheduled sessions will be billed in 1⁄4 hour increments at the corresponding hourly rate. All onsite work is booked with 3 hour minimums.  
  • Payment for services are to be made prior to the first session. Hours and packages purchased are non-refundable and must be used within 6 months of purchase date.
  • Credit cards are accepted through Venmo. On-site sessions not paid in advance by credit card are to be paid at time of service via check or cash. There is a return check charge of $35, as well as additional collection and/or legal fees to compensate for overdraft charges and unpaid balances.  
  • Travel time of up to 60 minutes round-trip is included in the above fee. Additional travel time will be billed at our standard hourly rate.
  • Donation Delivery Fee: Happily Organized will make recommendations and assist with arrangements for donations. If a client requests Happily Organized to take donations, the client agrees to pay an additional half hour of services per organizer’s carload. An organizer may take donations during the scheduled organizing service time at no additional cost. Donation dropoff is at the discretion of the organizer and tax receipts will not be provided.

ADDITIONAL SERVICES

  • Happy Organized can create a shopping list of products and supplies necessary for each session and, upon client request, purchase and deliver approved supplies to the client's location.
  • Client agrees to reimburse Happily Organized for all authorized expenses and shopping fees. Receipts for goods and services purchased will be provided at time of delivery and payment is expected at time of receipt or within the time frame specified. 
  • Trash Removal & Dumpster Rentals: The client is responsible for making arrangements for trash removal. Until Happily Organized physically sees the amount of trash to be discarded, it can be difficult to determine this need. We often suggest working with us for at least one full session before deciding if renting a dumpster is wise. IF REQUESTED, Happily Organized can assist in arranging and monitoring any dumpster rentals. 

APPOINTMENTS & CANCELLATIONS

  • Happily Organized will confirm scheduled consultations and organizing sessions 24 hrs - 48 hrs prior to appointment. 
  • Proper consideration regarding cancellations and appointment changes is expected. 
  • Appointments cancelled within 3 business days of the scheduled appointment time are subject to a $100 cancellation fee, which may be waived with rescheduling.
  • Failure to show up for a session will result in a charge for the full session. A client is considered a no-show 15 minutes after the agreed meeting time.  Missed appointments will also include any travel time above the 60-minute radius. 
  • Weather-related cancellations will follow the decisions of Bethany, IL (Moultrie County) and your local school districts, and NO cancellation fees will be assessed.

REFUNDS & CONTRACT TERMINATION

  • There are no refunds for completed services, gift certificates, or pre-paid packages. 
  • Both Happily Organized and the client have the right to terminate this business relationship at any time, provided that proper notice is given when cancelling an appointment.
  • Happily Organized may terminate the contract due to disruption of service on the part of the client. Disruption of service includes, but is not limited to: repeated appointment changes and cancellations, verbal abuse, acts or threats of physical harm, unsafe working conditions, and refusing reasonable requests.  


LIMIT OF LIABILITY     

The following limitation of liability clause (“Clause”) is a legally binding agreement between Happily Organized, LLC, and Client.  By entering into this agreement, both parties acknowledge and accept the terms and conditions outlined below.

  1. Scope of Liability:  Happy Organized, LLC’s liability for any damages, losses or claims arising out of or related to the services provided shall be limited to the total amount paid by the Client for the specific services rendered within the three (3) months preceding the incident giving rise to the claim.
  2. Exclusion of Consequential Damages:  In no event shall Happily Organized, LLC be liable for any indirect, incidental, consequential, special, or punitive damages, including, but not limited to, loss of property, loss of profits, or loss of data, regardless of whether such damages were foreseeable or arise from breach of contract, negligence, or any other theory of liability.
  3. Limitation Period:  Any claims against Happily Organized, LLC must be initiated within six (6) months from the date of service completion.  Failure to bring a claim within this period shall result in the complete and irrevocable waiver of any rights to such claims.  
  4. Force Majeure:  Happily Organized, LLC shall not be held liable for any failure or delay in the performance of service or any other obligations under this agreement due to causes beyond its reasonable control, including but not limited to, acts of God, natural disasters, war, terrorism, strikes, or government regulations.
  5. Assumption of Risk:  Client acknowledges and agrees that the services provided by the Happily Organized, LLC may involve inherent risks and uncertainties.  Client assumes all risks associated with the use or reliance on such services and releases Happily Organized, LLC from any liability arising out of or in connection with such risks.  Happily Organized is not responsible for any direct or indirect damage to items or surroundings, as result of a specific client request. 
  6. Independent Contractors:  Happily Organized, LLC and Client acknowledge and agree that they are independent contractors and that nothing in this agreement shall be construed as creating a partnership, joint venture, employment, or agency relationship between the parties.
  7. Severability:  If any provision of this Clause is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
  8. Entire Agreement:  This Clause constitutes the entire agreement between Happily Organized, LLC and the Client regarding the limitation of liability for services rendered and supersedes all prior discussions, negotiations, and agreements, whether oral or written.
